New Tobacco Retail License Ordinance in the City of San Jose

The San Jose Tobacco Retailer (TRL) ordinance before September 28th, 2021 only:
- Required retailers to purchase a permit from the city (and state) to sell tobacco products;
- Created an exemption/“loop-hole” for adult-only retailers that primarily sell tobacco products;
- Exempted retailers such as smoke shops and hookah lounges;
- MADE NO ADDITIONAL RESTRICTIONS!
We saw an issue with this, as our youth were being easily addicted to smoking and vaping, due to the tempting flavors that were marketed to them. Because of our community effort, the TRL was updated on September 28, 2021, ending the sale of flavored tobacco products and menthol. This is a huge accomplishment for the families and youth of San Jose!
Important Dates
- Effective November 19, 2021, new tobacco retailers are prohibited within 500 feet of another tobacco retailer and within 1,000 feet of a youth sensitive receptor. Adult-only exemptions were also removed from the tobacco license; now all tobacco sellers have to get a Tobacco Retail License.
- Effective July 1, 2022, the sale of flavored tobacco and e-cigarettes including menthol flavored products are prohibited in the City of San Jose.
